EPOWERFORMS IS A PROPRIETARY PRODUCT OF SERVICE AUTOMATION TECHNOLOGIES ("S.A.T.") AND IS PROTECTED BY COPYRIGHT LAWS AND INTERNATIONAL TREATY. YOU MUST TREAT THE SOFTWARE LIKE ANY OTHER COPYRIGHTED MATERIAL, EXCEPT THAT YOU MAY MAKE AN ARCHIVAL COPY OF THE SOFTWARE FOR EACH COPY, WHICH IS LICENSED, TO YOU. SOFTWARE LICENSE AGREEMENT
COMPANY WIDE LICENSE
READ THIS LICENSE AGREEMENT BEFORE OPENING THE SEALED MEDIA PACKAGE (S). THIS AGREEMENT IS A LEGAL CONTRACT BETWEEN YOU, THE END USER, AND SERVICE AUTOMATION TECHNOLOGIES, GOVERNING YOUR USE OF THE SOFTWARE. OPENING THE SEALED MEDIA PACKAGE (S) INDICATES YOUR ACCEPTANCE OF THIS AGREEMENT. THIS AGREEMENT SHALL ALSO BE BINDING ON ANY SUBSEQUENT, AUTHORIZED LICENSEE. IF YOU DO NOT WISH TO AGREE TO THE TERMS OF THIS AGREEMENT, PROMPTLY RETURN THE COMPLETE SOFTARE PACKAGE WITH THE MEDIA PACKAGE (S) (i) UNOPENED, TO SERVICE AUTOMATION TECHNOLOGIES, YOU WILL RECEIVE A FULL REFUND PROVIDED YOU RETURN THE FULL SOFTWARE PACKAGE, AND (ii) THE MEDIA PACKAGE (S) ARE UNOPENED. LICENSE
Each copy of the Software on a single-user computer or on a multi-user computer or a local area network, whether executing from memory or stored on a hard disk or other storage device, must be separately licensed, unless Company License specified above. (Number of licenses equals number of software keys received.) Company license is to be used exclusively by the company. Any distribution to other persons or companies outside purchasing company without written authorization from S.A.T. is strictly forbidden. If the software package contains more than on media type, you are licensed to use only one of the media forms.
You may not sublicense, rent or lease the Software. The purchaser of this Software accepts this Agreement and is licensed under the terms of this Agreement upon initially using the Software.
S.A.T. further grants you the right to make a backup/archival copy of the software media as set forth in the Notification of Copyright, above. You may not de-compile, disassemble, reverse engineer, copy, or otherwise use the software except as stated in this Agreement.
You are licensed to use the Software only on the operating system for which it was designed (e.g., Windows). Use of the Software on an operating system other than that for which the product was designed or the use in any other way decompiles or recompiles the Software or in any other way modifies the structure, sequence or function of the Software code, is not an authorized use, and further, such use voids the S.A.T. product warranty set forth below.
LIMITED WARRANTY/LIMITATIONS OF REMEDIES
S.A.T. will replace, at no charge, defective media and product materials that are returned within 30 days of the original shipping date. S.A.T. warrants that the Software, will perform in substantial compliance with the written materials accompanying the Software. If you report in writing, a significant defect to S.A.T., and S.A.T. is unable to correct it within 30 days of the date you report the defect, you may return the software and accompanying materials including all software keys, and S.A.T. will refund the purchase price. By opening the sealed media package(s), you agree that the only remedy available to you will be a refund of the purchase price of this software program package.
SUCH WARRANTIES ARE IN LIEU OF OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE SOFTWARE AND THE ACCOMPANYING WRITTEN MATERIALS, IN NO EVENT WILL S.A.T. BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY LOSS OF PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF OR POSSIBILITY OF SUCH DAMAGES. S.A.T. WILL NOT BE LIABLE FOR ANY CLAIM BY ANY OTHER PARTY.
This limited warranty gives you specific legal rights. Some states provide other rights, and some states do not allow excluding or limiting implied warranties or limiting liability for incidental or consequential damages. As a result, the above limitation and/or exclusions may not apply to you. Furthermore, some jurisdictions have statutory consumer provisions, which may supersede this section of the Agreement.
GENERAL
If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of the remaining provisions of this Agreement. The laws of the State of Massachusetts govern this Agreement
U.S. GOVERNMENT RESTRICTED RIGHTS
The Software and accompanying materials are provided with Restricted Rights. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (b)(3)(ii) of The Rights in Technical Data and Computer Software clause at 52.227-7013. Contractor/manufacturer is Service Automation Technologies, Neponset Valley Tech Park, P.O. Box 263, Canton, MA 02021.
